Once a JAM Ban has been imposed, that person (the "Appellant") has the right to appeal the decision of the Commissioner and seek to remove the JAM Ban. All appeals are heard by the Commissioner, who shall render a decision based upon his own judgment and the advice and assistance of the other Committee Members. To appeal a JAM Ban, the Appellant must be represented by a Committee Member. Such representation must be coordinated through the Chairman of the Justice Committee, who shall be present at the hearing of the appeal, and must be approved by either the Chairman of the Justice Committee, by three Committee Members, or by the Commissioner. The appeal shall be heard by the Commissioner at a date and time mutually acceptable to the Commissioner, the Chairman of the Justice Committee and the Appellant within thirty (30) calendar days of notice to the Commissioner of the appeal; provided, however, that if a JAM Ban be imposed within thirty (30) calendar days of the scheduled date of The JAM, the appellant may petition the Commissioner for an expedited hearing of his appeal. Should such an expedited hearing be granted, it shall take place no later than the calendar day immediately prior to the scheduled date of The JAM, unless circumstances dictate otherwise. All notices and petitions to the Commissioner must be evidenced by a writing, signed by the Appellant or by the Committee Member representing the Appellant at the hearing of the appeal, and shall be delivered to the Commissioner in person by either a Committee Member or by the appellant.
If, for any reason, a JAM Ban be imposed on the chairman of the Justice Committee, and said Chairman chooses to appeal the JAM Ban, then said Chairman must coordinate his appeal through the then senior Committee Member other than the Commissioner.
Notwithstanding any of the foregoing, in the event that a JAM Ban be imposed upon a Committee Member, said JAM Ban may be removed by the vote of a majority of those serving as Committee Members at that time, including the banned member, at a meeting of The JAM Committee. For purposes hereof, said meeting may be conducted by telephonic conference.
These By-Laws shall be effective as of this fourteenth day of June, 2001.
